By accessing and using this service, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using this websites particular services, you shall be subject to any posted guidelines or rules applicable to such services, which may be posted and modified from time to time. All such guidelines and rules are hereby incorporated by reference into the TOS.
ANY PARTICIPATION IN THIS SITE OR USING IT’S APPS WILL CONSTITUTE ACCEPTANCE OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ABIDE BY THE ABOVE, PLEASE DO NOT USE THIS SERVICE.
1. Visva Platform
- Use of the Visva platform by anyone under 13 years of ago is prohibited. You must be an adult of legal age of majority in the jurisdiction in which you live and access this service from.
- In order to provide a unique experience to each user, we provide a mechanism for users to create an account. During this process you will be asked to provide certain information about yourself. You agree to provide us with accurate information when you create your account. We will treat information you provide during this process or at any other time in accordance with our Privacy Policy.
- Our use and treatment of personal information we may obtain through the use of our services as both a registered and unregistered user is detailed in our Privacy Policy. By using the service you agree to the terms set forth there.
- When accessing or contributing content to the service, you agree to abide by our Acceptable Use Policy
- We reserve the right to limit access, suspend, or remove your account for violating any policy or for any other reason.
- The evolving nature of our platform means that your experience may change and we may add or remove features without notice.
- While we welcome your ideas and embrace your feedback, when such feedback is submitted you grant us the right to implement, modify, disclose, share, or otherwise use such feedback, in whole or in part, freely and without compensation or credit to you.
2. Content
- The Visva platform enables you to create and share information in the form of posts, stories, comments links, pictures, and other formats that will be shared with other users. All material you contribute will be collectively referred to as “Your Content”. As part of using the Visva platform, you agree with Your Content will be viewed by the general public.
- You, or your licensors, as applicable, retain ownership of the copyright and other intellectual property in Your Content, subject to the non-exclusive rights granted to use below.
- By submitting, posting, or displaying Your Content on the Visva Platform, you grant Visva and its affiliated companies a nonexclusive, worldwide, royalty free, fully paid up, transferable, sublicensable (through multiple tiers), license to use, copy, reproduce, process, adapt, modify, create derivative works from, publish, transmit, store, display and distribute, and otherwise use Your Content in connection with the operation or use of the Visva Platform or the promotion, advertising or marketing thereof, in any and all media or distribution methods (now known or later developed). You agree that this license includes the right for Visva to make Your Content available to other companies, organizations, business partners, or individuals who collaborate with Visva for the syndication, broadcast, distribution or publication of Your Content through other media or distribution methods. This license also includes the right for other users of the Visva Platform to use and modify Your Content, subject to our Terms of Service.
- Once you post Your Content to our platform, you may have the option to edit or delete such content. These features have limitations and some content may remain accessible to users. We do not have the ability to control content that has been shared or copied outside of the Visva platform. The right for Visva to copy, display, transmit, publish, perform, distribute, store, modify, and otherwise use any question you post, and sublicense those rights to others, is perpetual and irrevocable, to the maximum extent permitted by law, except as otherwise specified in this Agreement.
- You acknowledge and agree that Visva may preserve Your Content and may also disclose Your Content and related information if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable laws or government requests; (b) enforce these Terms of Service; (c) respond to claims that any of Your Content violates the rights of third parties; (d) detect, prevent, or otherwise address fraud, security or technical issues; or (e) protect the rights, property, or personal safety of Visva, its users, or the public.
- You understand that we may modify, adapt, or create derivative works from Your Content in order to transmit, display or distribute it over computer networks, devices, service providers, and in various media. We also may remove or refuse to publish Your Content, in whole or part, at any time.
- You further give us the permission and authority to act as your nonexclusive agent to take enforcement action against any unauthorized use by third-parties of any of Your Content outside of the Visva Platform or in violation of our Terms of Service.
- By posting Your Content on the Visva Platform, you represent and warrant to us that i) you have the ownership rights, or you have obtained all needed licenses or permissions from any necessary parties, to use Your Content and grant us the rights to use Your Content as provided for under this Agreement, and ii) that posting Your Content violates no intellectual property or personal right of others or any applicable law or regulation. You accept full responsibility for avoiding infringement of the intellectual property or personal rights of others or violation of laws and regulations in connection with Your Content. You are responsible for ensuring that Your Content does not violate Visva’s Acceptable Use Policy, Copyright Policy, Trademark Policy, other published Visva policy, or any applicable law or regulation. You agree to pay all royalties, fees, and any other monies owed to any person by reason of Your Content.
3. Our License to You.
- We grant you a limited, non-exclusive license to use and access Our Content and Materials and Data as made available to you on the Visva Platform in connection with your use of the Visva Platform, subject to the terms and conditions of this Agreement.
4. Intellectual Property or Other Violations
- You may contact us by email at [email protected] or in writing to the following address to report violations of intellectual property. Please be sure to including detailed information on what content you’re referring to, where it exists on the platform, and how it is violating your rights. We have no obligation to delete content that you personally may find objectionable or offensive. We endeavor to respond promptly to requests for content removal, consistent with our policies and applicable law.
- We will respond to legitimate requests under the Digital Millennium Copyright Act, (“DMCA”), you may submit a properly formatted DMCA request (see 17 U.S.C. § 512) to the address below or via email to [email protected]. You must include the following in such a request:
- The electronic or physical signature of the owner of the copyright or the person authorized to act on the owner's behalf;
- Identification of the copyrighted work claimed to have been infringed, or a representative list of such works;
- The URL or Internet location of the materials claimed to be infringing or to be the subject of infringing activity, or information reasonably sufficient to permit us to locate the material;
- Your name, address, telephone number and email address;
- A statement by you that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent or the law;
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
